Hey,
I have a 290B pending at Texas which was submitted on 20 Nov 2007. I had a LUD on 27 Nov. Nothing happened after. Based on others experience (in NSC) it is taking about 4 months for something to happen. No clue about TSC. Just sit tight and have a backup plan. Good luck.

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?
Also, for 140 application do I have to sign on any PERM labor related document ?

H-1B employers need to be aware that June 30, 2009 will be the last day that the Department of Labor�s LCA Online system will be operational. As of July 1, 2009, all LCAs for H-1B and E-3 cases will need to be submitted through the iCERT portal (http://icert.doleta.gov/) and that means the end of instant LCA certifications.
This has very important implications for the timing of H-1B and E-3 applications as they relate to new hires and extensions. Employers will need to allow for delays in LCA certifications of at least 7 days rather than the instant certifications that were previously issued.

Hi,
My Visa expired in Apr08. I have RFE on the extension.
If my extension is rejected, I understand that I can apply for H4. (Since my husband is on H1)
Please help mw with few queries
1) Do I have to apply for H4 before my H1 gets rejected OR only after it gets rejected
2) Do I have to go back to India to get my H4 done
Please help

Experts,
I am planning to use AC21 and start a new job on EAD, although the reason I am telling my present employer is that I am going to home country and may or may notcome back. what happens if the employer revokes the H1B or can he ask uscis to stop all the immigration matters with me. I have finished 180 days hatch period ...:)

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

HI,
I am in my 7th yr extension of H1B, last time I got the stamping in Ottawa in 2005. I cam e into US on F1 and never got H1B stamping in India. Am I eligible for H1B stamping in Canada for my 8th year or should I go to India to get the stamping done.

A new visa bulletin gets released every month sometime during second week. Keep checking for your date and when it becomes current, you can apply for I485 and if need be you can apply for EAD and/or AP.
Check the bulletin to have an idea on how long you will have to wait.

My company has been going through layoffs for the past 3 quarters and are unable to start my GC process. I believe they have to wait for 6 months before they go forward and apply. I am talking about a big company with different departments like operations, marketing and most of the layoffs are happening in these, but recruitment is active in IT. They are regularly recruiting new resources and increasing the head count.
I have following questions:
1) Can my company show that the layoffs are happening in different depts and go ahead and process my GC?
2) What is the risk in doing so.
3) Anyone experiencing a similar situation and could successfully get their GC process started and have approved labor/I140?

I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).
