Hi,
My current H1 is valid till Feb 15 2010. My lawyer filed for H1 extension in Aug 2009, almost 6 months before the visa expiration date.
After 3 months my lawyer filed an enquiry with the CIS and CIS responded back saying they had sent an RFE on Dec 16th 2009 to my employer. However, my employer hasn't received any mail from CIS. Then my lawyer requested the CIS to send another copy of the RFE on Dec 30th 2009.
However, till date nothing has been received in the mail. Is there any way I can get to know what RFE has been issued by CIS?
It has been 6 months since filing my extension at CIS CSC and uptil now there is no news. Can CIS get any worse when it comes to H1 extensions..I don't think so.

My EB3 I140 got approved in June2008. I am planning to convert EB3 to EB2 and preparing to apply labor through EB2. If EB2 labor got denied, is my EB3 I140 still valid? Do i get a RFE if apply for I485 using EB3 I140? Any Lawyers please..

I have been reading a lot of late about troubles/Denials given to H1B visa holders at POE.
I have been in US for few years now on H1 working as Marketing Manager and traveled smoothly so far. Planning for a short vacation to Europe. Should I?

Folks,
I just realized that I forgot to add a piece of my employment history to the DS-160. I only realized it once I set up the appointment for H1-B stamping through VFS. I have all the corroborating paperwork (W2, paystub etc.) for that period. Do I need to re-do the DS-160? I already have an appointment and if I cancel the appointment and re-do the DS160 I might run the risk of not getting the date of my choosing. The problem is my existing company is a "successor in interest" of the company I forgot to mention. That is, I got my I-797 from this previous company.
Please not that the facts in the existing DS 160 are true. It is just that I realized that there is a gap that I might have to fill.

I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

Hello:
I got two EAD extensions in past and applied for the same third time. Earlier, EAD Renewals took only 2 weeks time ( from VSC). But this time it is not the case. It is still pending for 4 weeks now.
Are there any recent EAD renewals from TSC for anyone? Please let me know if anybody has similar case?
PS: Since my case(I-485) was transferred from VSC to TSC, I applied for EAD renewal at TSC this time.

Just Ask her to redo the I-9 Employment Verification form and submit to the Employer. Nothing else needed.
My friend H1B is expiring this month end but she has valid EAD wth her.When we are planning to use EAD from H1B,what is the procedure for that?Do we have to send any forms to INS for this change of status??

On mar 12th I got a query on I-485.
It says.
The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.
There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.
I filed my labor and I-140 I was in california, i moved to different state since I filed my 485, till now I am with the same employer.
Any gurus who can suggest me on the query would be greatly appreciated.

My PD is 02/2004 EB2-India, and I will be current in June. However, as noted by multiple folks, there is a chance that EB2-India might retrogress during the rest of the fiscal year.
Have folks had luck with an InfoPass interview so push your case? I am afraid that without any encouragement my case will just languish on somebodys desk or in a box.

My attorney filed I-140 on July 5th. No receipt yet. No news also.
He said he cannot send it to TSC, instead he mailed it to NSC. Is that the standard filing place?
Do you have a notice for your standalone I-140 filed at NSC on or after July5th.
