I-765 instruction (http://www.uscis.gov/files/form/I-765instr.pdf dated 05/27/08) seems to be old for student instruction and payment instruction.

Hi,
I'm in my 7th year of h-1b with approved I-140. planning India trip this summer and will have to go through painful h-1b stamping in Hyderabad.
I work full time for a big firm (10000 employees) and have masters in US.
Would be really helpful if you can share your h-1b stamping experience in recent months. Getting little paranoid reading about increase in 229g these days even after producing all docs.
Also is it fine to travel and get stamping when one is beyond 6 yrs of h-1b with GC underway.

My h1 is approved in this years quota but i have not received I797. During this period if my h4 is stamped will my h1 be cancelled. or can i go to US on

I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
>> Can i go to mexico and get the visa stamped during my stay there..is it risky???

I have B1 visa and and right now I am in US on client support.
I want to get into a College for further studies for which I am unaware of the legal formalities to be completed.
I already have a letter of internship with a US company and the college is giving me a letter for change of status i-20.
As far as the immigration goes for change of status of visa, it says that I need to go out of the country and then come back, with stamped as 'intent to study'. So is it really required?
However still it is confusing for me as to what other formalities are to be completed regarding the same.

Hi,
I am in weird situation. I left my previous employer because they didn't file for my concurrent filing during July '07 madrush.
They applied for my I-140 on 26th Sept 2007 thinking that I may change my mind and stay with them.
It seems that they didn't revoke my I-140. Since, yesterday, I got email notification from CRIS about I-140 approval.
Now a question for Gurus:
I am not sure but my previous employer may revoke it anytime. Based on the email notification and the online approval snapshot, can I port my priority date to my current application, with new employer, even if previous employer revoked my approved I-140 ?
Personally, I was happy with my previous employer except for the concurrent filing that they didn't apply. Now, I am in dilemma. should I should rejoin my previous employer or not?

I am currently working in Michigan. My PD is "Feb 2006" and my 485 has been filed during 2007 July fiasco. My 140 was approved in April 2008.
I planing to move a different company in Connecticut on my EAD ( valid till 2010 end). But Connecticut falls under Texas SC where as my GC is filed in Nebraska.
Do you feel this is an issue. What kind of headache this can cause?
My AP renewal is pending with Nebraska and I guess i won't get that before I move.

Hi All
I am currently working for Company A and have an approved I-140 with Company B, PD May 2004, EB2 category.
Company B applied from my H1- transfer last week, not under PERM though.
I do not yet have the receipt number of the H1 transfer and it may take 2 to 3 months for the actual H1 transfer to happen.
With the PD current, I have the following questions
1> Do I have to wait for the actual H1-transfer to finish before filling my I-485 or is it OK to start the I-485 with a receipt #?
My guess is the I-485 is an adjustment of status and since GC processing by an employer is for future employement it should'nt even matter if I am an employee when filling I-485 with the employer.
Can some experts/ senior members comment and throw some light on the matter.
Kindly reply.

1. If we withdraw I485, can I apply for B1 visa later to come back for business? Or because we have applied for immigration visa, our B1 application will be denied?
