I am applying for H4 visa after my recent marriage with an H1B visa holder in USA. I am currently filling out the online DS160 form but stuck at the following stage: "travel information"
In the purpose of trip to USA question: the given options are business, travel or student visas, so i selected the option: "other". On selecting this, the form loads a list of further options in order to SPECIFY: the H4 option (dependent of H1B holder) is not given in this list. The nearest applicable option is "temporary employee H1, H2". When I choose this one, then at a much later stage in the application, in the section titled "temporary work visa information" the form starts to ask information on my supposed employer etc, which is clearly UN-applicable in my case, as I am NOT applying for an H1 or H2 visa. Kindly help me out, on how to proceed with DS160 in such a situation. Waiting for reply with anticipatory thanks. Sadatj.

You should be protected by the 180 day grace period provided by �245(k).

I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.
Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.
In this form DS-230 I need to fill field name "Present Address".
I have following question:
- In this form what should I fill my present address
Indian address
OR
US address.
(what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)
What do you guys suggest?

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

Experts,
I am planning to use AC21 and start a new job on EAD, although the reason I am telling my present employer is that I am going to home country and may or may notcome back. what happens if the employer revokes the H1B or can he ask uscis to stop all the immigration matters with me. I have finished 180 days hatch period ...:)

How many weeks of all possible unpaid leave can i avail while on EAD ?
Did you apply late or is there a delay in processing? Which center did you send your renewal to?

Hi,
My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

I have been in the US for a couple of years working on an E-1 Visa. I am now filing my I-765 because my Visa is tied to me working for a particular company and is not transferable. I have a social security card.
I am now not sure if I should fill this out as if I am applying for a or b:
A) Permission to accept employment
B) Replacement (of lost employment authorization document)
C) Renewal of my permission to accept employment (attach previous employment authorization document). Form I-76
If it is C, should I attach a copy of my E-1 Visa and my Social Security card or something else?
Also, for question 11 (Have you ever before applied for employment authorization from USCIS)? I don't think I have. I think my E-1 Visa came with this right and that I only dealt with the social security office.
Please help if you know the answer

I was selected in H1b lottery last year however my petition was sent back to DSH for revocation.
I emailed US embassy in Pakistan a couple of time however did not receive any response from them as yet on my case status. So my petition has been returned to DSH but H1b visa has not been rejected yet.
Now another company is offering me a job. My question is that can I use my previous petition and my new employer can apply for H1b without applying for the H1B lottery again. This will be switching employer before H1b Visa approval OR is it that I will have to wait until some decision is taken on my returned petition to DSH?
Any suggestions will be much appreciated!!

Hello Forum Members -
My company has applied for my 8th year extension (3 years) based on my LC and I-140 that was applied in CA. (My LC and I-140 have been approved). But during my 7th year, I moved to NC state with the same company/department. The LCA for the extension includes both CA nad NC work locations and NC residence address.
Will there be a problem with extending the H1 using the I-140 that has been approved for CA? Will USCIS question why I am in NC when the I-140 shows a CA Address?
Please let me know your opinion.

My company is processing my Green card and recently applied my I-140. My wife is applying for residency this year. Most of hospitals are saying that they can sponsor only a J-1 visa. Can you please suggest if this would be a problem for my Green Card processing and/or her visa stamping (Since applying for G.C means that we wants to stay and J-1 means the other way round)?

Yes, as long as the new job is same/similar to job B. The 180 days count is number of calendar days i-485 is pending, not number of days on the job. One may not even be working at all during that 180 days, or even while waiting for i-485 approval however, must have a very good excuse because IOs will be very suspicious. It is not violating any rules though as i-485 is for future employment.

A friend of mine (Indian) is married to an Indonesian. Both are on H1B and have approved I-140s. Can my friend apply for a cross changeability? Does it have to happen when my friends spouse's pd becomes current? or can it be done earlier?
Yes he can use Cross changeability.

I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.
Please help. I'm just not able to get this over my head :(

AP not yet received. But EADs have been received for me and my husband (primary applicant). However, my daughter is yet to receive her EAD. Anybody with a similar case? I tried calling IO in USCIS but they say that it may come any time within 90 days of the notice date (not the receipt date!):mad:
