The USCIS has issued guidelines for petitioners filing cap-subject H-1B petitions for Fiscal year 2011. Folks,
If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.
Please refer to Yates Memo for AC21.

A report from the Leadership Conference on Civil Rights Education Fund shows that hate crimes targeting Hispanics rose 40% from 2003 to 2007. The report can be found here. Hi Gurus,
My PD is Aug 2005 (EB2 India). Last year, during September - October my case was picked up and I think it is processed, but because of lack of visa numbers, the case was not approved. (I wrote a senator letter, he got back saying that the file is processed and waiting for visa numbers)
Now, I got 2 offers. First one is a fulltime position and 2nd one is a contract with a primary vendor (directly working on W2 using EAD). I haven't decided which one to join.
What are the options, I have? Do I need to file AC21? Since my file is already processed and waiting for the PD to become current, am I OK, even if I don�t apply for AC21? If I file AC21 and if the job descriptions are not matching or because of any other issues, if there is an RFE, I will be having some issues.
Gurus please let me know your thoughts.

I have an approved I 140 application and I485 not applied as the dates are not current. I have an opportunity to work for the same company same job profile and job code but in a different city. The new city falls under the same Metropolitan statistical area. Do I still need to re file my perm and I 140 in addition to H1b amendment ?

Seeems there is bigger gameplan around here..
a compromise has been reached between Democrats and Republics for CIR.

Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

Please be advised that the Nebraska Service Center (NSC) has been experiencing delays in the processing of I-765 EADs and I-131 Advance Paroles. Therefore, we recommend that EAD and AP renewals be filed 4 months prior to the expiration date, the earliest date USCIS will accept renewal applications. For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. Please contact our office for assistance with expedite procedures for your pending I-765 or I-131 application if your current work authorization is about to expire or if you have an emergent need to travel.

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...
