Gurus,
I am planning to schedule a H1/H4 stamping visa appointment for next month. Here are few questions regarding the vfs web site.
The date I am planning to schedule is still not showing as available. My question
is can I enter all my data and save it and once the date shows up, can I select
the date? How does it work? If not do I need to enter all the data on the day
when it opens up?
thanks
Iad

This is really major and thanks to reader gg for posting the link. The headlines are likely to be about the benefits to people out of status. The provisions stated early in the memocould benefit thousands, though I'm not sure it will help the vast majority of people out of status, though many, many would be helped. Mayorkas has "buried the lead" at the end of the memo when he discusses using "deferred enforced departure" to potentially help those who otherwise might qualify for the DREAM Act as well as long time residents (those here since before 1996 are specifically...

Immigration activists say they are hopeful that Gov. Deval L. Patrick will support proposals in an advisory report calling for more English classes for the states immigrants and in-state tuition for undocumented college students. Patrick released the report containing 131 recommendations, which he called a values statement, at a luncheon for immigrant advocates.
Since July 2008, resident immigrants and activists have crowded meetings around the state pressing for those programs and others, including allowing immigrants to get state drivers licenses.

Professor Raul Hinojosa-Ojeda of UCLA (and a former Immigrant of the Day) has authored a major report that has been released by the Center for American Progress and the Immigration Policy Center that shows that fixing the country's immigration system could produce massive economic benefits for the US. The report shows the following: This report uses a computable general equilibrium model to estimate the economic ramifications of three different scenarios: 1) comprehensive immigration reform that creates a pathway to legal status for unauthorized immigrants in the United States and establishes flexible limits on permanent and temporary immigration that respond to...

The New York Times reports that tomorrow Immigration and Customs Enforcement will be sending instructions to agents in field offices aimed at changing their enforcement focus from work site raids that largely resulted in mass arrests of workers to I-9 audits and undercover investigations mainly targeting employers. However, workers will still be subject to arrest. According to the Times, the guidelines are partly a response to ICE's blindsiding DHS Secretary Napolitano with an unauthorized raid on a Bellingham, Washington mechanic's shop, which I discussed here.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. This means that the agency has received 700 more H-1B petitions than it can approve. Why then is the USCIS still accepting H-1B petitions? Because some of the petitions that...

Hi, I have my labor approved by Company A and I140 filed as soon as I got the labor. Before this I140 got approved I changed to Company B who filed for my labor and applied for I140 as soon as it got approved. My I140 with company B got approved and then the I140 with the old company A got approved 3 months later. Can I somehow get the old PD. Can some one who have been in similar situation or know some one in the similar situation answer this. I will be able to get a 2 year advance if this works out.

My case
EB-2
I-140 Approved 2008
I-485 pending [ concurrent filing]
Have valid EAD [me and wife] but never used it. Still on H1B and H4 respectively.
I am on second term H1B which expires on Oct-2010.
Project is ending and I have to find new job. Current company applied for EAD renewel last week. But didn't want to spend for H1B renewal since I might change jobs. I am planning to invoke AC21 and shift to similar job. I want to know what is the last date for me to renew/port my H1B ?
My wife used her Advance Parole for travel [but did not use EAD for job], does that mean she is not in H4 anymore ?
Thank you friends. Any advise would be appreciated.

For those of you that have NOT contributed and RETROGRESSION is affecting your lives.
Wake up and do something for yourselves!!
What is the matter with you folks??
Why does it have to be pointed out time and again, that by contributing, not only are you strengthening IVs hands but this will eventually allow you to achieve your goals and improve your lives.
Is this a big task?
At least stay united for ONE cause in your lives.
All that is needed is a small contribution, nobody is asking for blood or your first born!!

- recently obtained a duplicate passport for my stolen passport, unfortunately also lost I-94 when received in Dec.08.
- Can I use the I-94 attached in the bottom of the I797? I won't have time to submit I102 and wait for replacement I-94.
- I've a trip coming very soon to Germany, last year had obtained the H1b stamping at US consulate in Germany, will it be ok if I apply for restamping at the same consulate because of time factor I'm not able to Canada or Mexico or India.
Any help and advise will be much appreciated. thanks !

My H-1B expires next year (after 6 years). I have been here 10 years (on J-1 and then H-1B visa). My employer isn't in a position to apply for Labor Certification, although they want to continue hiring me. I want to stay (no relatives here etc.). I know after one year, I can return on a new H-1B if my employer will petition again but it is messy and I want residency. I am from Britain. Help!!!

Hello Attorney`s
I am in a weird situation here, I was Laid off on July 21st with pay in lieu until 4th August. I had applied for Change of Status to F2 (my wife is on F1) on 17th August. On 31st August I got a job offer and applied for H1B transfer to USCIS on 8th September (using 15th august paystub as the latest).
At the same time i filed to USCIS to revoke my F2 application.
Today I got a notice from USCIS that my application for change of status to F2 is approved as of 09/21/2009.
Now, I dont know what to do, does it mean I am now on F2? Is my H1B transfer application still valid or I need to apply again this time on premium processing.
What should be my next course of action. Any help in this regard would be highly appreciated.
Thanks so much..!!
Have a great day..!

Democrats step up (http://www.latimes.com/news/opinion/editorials/la-ed-mileage25jun25,1,1445539.story) First on gun control, now on energy, the Democrats are pushing Congress in a new direction. June 25, 2007
FIRST GUN CONTROL, now fuel economy. Congressional Democrats still have a lot of work ahead to get their groundbreaking bills past both houses and the president's desk, but you can't say they're not leading a radical change in direction.
On June 13, the House passed what could become the first major gun-control law in a decade, a bill aimed at strengthening a federal database used in background checks for gun buyers. A week later, the Senate approved an energy bill that would improve mileage for the nation's automotive fleet for the first time in nearly 20 years. Democrats still haven't forced a troop reduction in Iraq or put their stamp on the nation's backward immigration policies, but their surprising success in other areas is worthy of praise.
Not that Democrats deserve all the credit. The gun bill was a bipartisan effort that passed by acclamation after it won the blessing of the National Rifle Assn., while 20 Republicans nearly half the 43 who voted on the measure backed the fuel economy bill. Still, these measures would have been inconceivable while Republicans controlled both houses during the first six years of the Bush administration, a period characterized by the disgraceful decision to allow a decade-old assault weapons ban to expire in 2004 and successive energy bills focused on maximizing fossil fuel production at the expense of the environment.
It would be nice to think that the broad Republican support for a progressive energy bill signaled a pro-environment change of heart. Unfortunately, it probably has more to do with the high price of oil; Republicans are feeling pressure to bring gas prices down. They also rightly see dependence on foreign oil as a national security issue. The fuel economy bill would increase the average mileage requirement for cars sold in the U.S. from 25 miles per gallon to 35 by 2020, expected to eventually save millions of barrels of oil a day.
Regardless of their motives, Republicans' support for the energy bill will increase pressure on President Bush to sign it, assuming it gets through the House. Bush favors better fuel economy but wants it to come at a slower pace, with loopholes to allow more gas guzzling by SUVs. The Senate energy bill has its own regrettable loophole: A strong mandate was watered down in committee, allowing federal regulators to cancel the improvements if they decide the tighter standards aren't "cost-effective." But senators beat back furious efforts by the auto industry to weaken the bill further.
There was one sour note to last week's passage of the energy bill: An amendment that would have required the nation to get 15% of its electricity from renewable sources was defeated. Senate leaders should revive it in the future.
