Could someone please detail the process of adding your wife to the existing 485 application. I am sure there are many folks like myself who had applied for 485 before they got married and now have to add their spouses whenever the dates become current

My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.
Is this acceptable for a fiance visa? Thanks.

sorry, posted this under wrong category I don't know how to delete it.
I received a RFE regarding medical test because the Civil Surgeon didn't complete some of the forms properly. I replied bak to the RFE few days after I received it (within the allowed time).
my question is how many days does it take USCIS on average to look at my reply to the RFE and make a decision on my I-485 application (my PD is current as of June VB and been current for months now)
if USCIS does not make a decision and if PD retrogresses in July VB and I won't be current, does that mean that USCIS won't make a decision then untill my PD is current again???
Please advise. Thank you

I left the U.S on October 30 2009. My L.C. [Perm] had been filed on July 30 2009 and was recently approved.
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.
My company needs me to return to the US urgently and is wanting me to apply for a Business Visa.
Subsequently when I am in the U.S, they intend to file for I140 and then 7th year H1B extension plus recapture
time based on pending I140
Is this feasible? -- What impact would it have on my green card application process?
My 6 year H1B expired on Feb 2 2010, with approximately 160 days available for recapture.

Should be pretty straight forward. Ask her to take the signed I-20, financial support docs, letter from the department, and also from advisor (if possible). Though in our case, the VO didnt ask for a single doc but its good to have them all.

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. After nearly seven months of battling Republican filibusters and controversial amendments on the Senate floor, Majority Leader Harry Reid (D-Nev.) said Friday he may seek to change Senate rules to make it easier to restrict amendments on the floor.
Reid said Rules and Administration Chairwoman Dianne Feinstein (D-Calif.) would be tasked with exploring what rules changes should be made.
Noting that there has been a "growing breakdown between the majority and minority in terms of how to get things done," Howard Gantman, Feinstein's chief of staff for the Rules panel, said the committee would conduct a "comprehensive review" and look at the rules on the germaneness of amendments and how long Senators have to review proposals before voting on them.
"Sen. Feinstein is very serious about looking at the vast range of amendments that are brought in at the last minute that are not germane," said Gantman. He added that the panel's focus would be on "how to better get things done."
Reid spokesman Jim Manley cautioned that Reid "has no intention of unilaterally seeking a rules change."
However, Minority Leader Mitch McConnell (R-Ky.) scoffed at the notion of limiting or restricting Senators' ability to offer amendments, which he likened to freedom of speech.
"Look, nobody's going to shut anybody up in the Senate," he said at a press conference Friday. "There's going to be robust debate. You can just write that down. And I understand Sen. Reid's frustrations, but we're not going to establish any speech police in the Senate - not now, not ever."
Reid apparently reached his boiling point Thursday night when Republicans used Senate budget rules to offer a number of non-germane amendments to a student loan financing bill.
"What went on last night was ridiculous," Reid said on the Senate floor. "We should change those rules. ... We will have to take a look at that."
Reid said Health, Education, Labor and Pensions Chairman Edward Kennedy (D-Mass.) and ranking member Mike Enzi (R-Wyo.) managed the student loan measure "very well until it ran into the rule that we have here that allows unending amendments on any subject forever, literally, before you get to final passage."
Because the higher education bill - by virtue of its status as a budget reconciliation measure - was immune to filibuster, Senate rules permitted unlimited amendments to be offered and voted on. On Thursday night, in particular, Senators were given only a few minutes to review the substance of some amendments before they were asked to vote on them.
As is customary with budget and reconciliation measures, Senators engaged in a long series of back-to-back votes, known as a "vote-a-rama," at the end of the debate. But Democrats said Republicans' insistence on having 14 non-germane votes - including six related to cutting taxes, three related to immigration and two related to terrorism - was excessive.
When Democrats pushed back with their own non-germane amendment expressing the Senate's opinion that President Bush should not pardon Vice President Cheney's former chief of staff, Scooter Libby, Republicans tried to force a vote on former President Bill Clinton's controversial pardons.
But before the Senate could vote on that, Reid asked that both the Libby vote and the GOP pardons amendment be stricken from the Congressional Record, and the chamber voted on final passage of the bill.
Manley explained: "These so-called vote-a-ramas are bad for the system, and they may lead to bad policy. As have leaders in the past, all Sen. Reid was doing was expressing his frustration at the Republicans' desire to score cheap political points at the expense of a good-faith effort to pass a bill that will make college education more affordable for more Americans."

Hello
I am working on H1 and my current H1 petition is valid until April 6th 2011.
My visa (stamp) expired in Nov 2009.
I have my new H1 extension petition approved from April 7th 2011- 2014( same employer).
I am going to India early Feb and will going to Hyd/Chennai for visa stamp.
In the visa appointment it is asking for my petition number: which one should I give current or the new extension one. I would like to have my H1 stamped until 2014 so that I can avoid additional trip to consulate.
Please help.

I left my Indian consulting company and the employer owes me $14,000 which he is now refusing to pay, he says he will deduct it as a cost of H1 and GC processing fees
When I started working for him he told me that he would take care of all these costs(of course he did not give this in writing) and not at anytime was there a verbal or written agreement that I would have to repay him these costs if I left him.
What recourse do I have now?

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question or suggest any other possibilities for rejection?
